Terms and conditions of use

These terms and conditions are the terms of use (referred to below as the “Terms of Use”) on which you may make use of the EdLab open learning platform (“the EdLab Platform”), as a registered user (“User(s)”).

Please read these terms of use carefully before you start to use the EdLab Platform.

By using the EdLab Platform, you indicate that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms of use, you will not be entitled to use the EdLab Platform.

JANET(UK) may make reasonable changes to these Terms of Use at any time by amending this page. You agree to regularly check this page and to take notice of any changes to these Terms of Use.

You agree that all reasonable changes to these Terms of Use will be accepted by you unless you provide JANET(UK) with notice by email to edlab@ja.net in which event your right and licence to use the EdLab Platform will immediately terminate.

Your concerns

If you have any concerns about any materials or information, which appears on the EdLab Platform, please contact edlab@ja.net specifying the relevant materials or information and setting out the nature of your concern. JANET(UK) will consider and address (without accepting any obligation to take or not to take any specific actions) your concerns.


Information about the platform and us

The EdLab Platform is run on Fronter a web-based application owned and operated by Fronter UK Limited ("Fronter UK").  Fronter UK is a privately owned company limited by shares and is not connected in any way with JANET(UK).

Fronter UK has licensed JANET(UK) to make the Fronter Platform available for your use, provided that you accept and comply with these Terms of Use.

On acceptance of these Terms of Use by you, JANET(UK) grants you a non-exclusive, non-transferable licence to use the EdLab Platform for your own personal non-commercial use, in accordance with these Terms of Use ("Your Licence").


Accessing the Platform

You are responsible for making all technical, network and other arrangements necessary for you to have access to the EdLab Platform.

JANET(UK) reserves the right to withdraw or amend the services, information and facilities provided by the EdLab Platform and/or to terminate Your Licence without notice.

From time to time, JANET(UK) may restrict Users’ access to some parts of the EdLab Platform, or the entire Platform.

If you are provided with a User identification code, password or any other piece of security information as part of the security procedures implemented by JANET(UK) and/or Fronter UK from time to time, you agree to treat such information as confidential and personal to you, and you agree not to disclose it or allow it to be used by any third party.

JANET(UK) has the right to disable any User identification code, password or similar security information at any time, if JANET(UK) believes that you have failed to comply with any of the provisions of these Terms of Use.

Use of the EdLab platform

You may use the EdLab Platform only for lawful purposes. Specifically (but without limitation), you may not use the EdLab Platform:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harassing, harming or attempting to harass or otherwise harm any other person in any way;
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with JANET(UK)’s content standards (referred to below); or
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (including non solicited correspondence commonly referred to as ‘spam’).

You agree not to interfere with, damage or disrupt any part of the EdLab Platform.

You agree not to access, interfere with, damage or disrupt any part of the equipment or network on which the EdLab Platform is stored, or any software used in the provision of the EdLab Platform.

Links to the EdLab platform

The EdLab Platform must not be framed on any other site, nor may you create a link to any part of the EdLab Platform.

If you wish to make any use of material on the EdLab Platform other than as permitted by these Terms of Use, please address your request to edlab@ja.net.

Links from the Edlab Platform

Where the EdLab Platform contains links to other web sites and/or resources provided by third parties, these links are provided for your information only.  JANET(UK) has no control over the contents of those web sites or resources, and accepts no responsibility for them or for any loss or damage that may arise from your use of them. 

Viruses hacking and other offences

You must not misuse the EdLab Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material, which is malicious or technologically harmful or otherwise attack the EdLab Platform.

You must not attempt to gain unauthorised access to the EdLab Platform, the server on which the EdLab Platform is stored or any server, computer or database connected to the EdLab Platform.

Breach of these terms may constitute a criminal offence under the Computer Misuse Act 1990. JANET(UK) will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the EdLab Platform will cease immediately.

JANET(UK) will not be liable for any loss or damage caused by any virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the EdLab Platform or to your downloading of any material posted on it, or on any website linked to it.

Reliance on information posted

Materials and information posted on or accessed via the EdLab Platform are not intended to amount to advice on which reliance should be placed.  Any of the materials and information on the EdLab Platform may be out of date at any given time, and we are under no obligation to update such material and information.

We do not routinely monitor the materials and information on the EdLab Platform.

(To the extent permitted by law) JANET(UK) therefore disclaims all liability and responsibility arising from any reliance placed on such materials and information by you or any other visitor to the EdLab platform, or by anyone who may be informed of any of its contents.

Interactive Services

Interactive services may be provided on the EdLab Platform from time to time, including without limitation chat rooms, bulletin boards, instant messaging services and details of Users who are online from time to time (“the Interactive Services”).

Where Interactive Services are provided, JANET(UK) will use its reasonable endeavours to assess any possible risks for Users from third parties when Users use any Interactive Services.

JANET(UK) will decide in each case whether it is appropriate to use moderation of the relevant Interactive Services (including what kind of moderation to use) in the light of those risks.

JANET(UK) is under no obligation to oversee, monitor or moderate any interactive services, and (to the extent permitted by law) JANET(UK) expressly excludes all liability for any loss or damage arising from the use of any interactive services by a user, whether the interactive services are moderated or not.

Where any Interactive Service is moderated by JANET(UK), a means of contacting the moderator should a concern or difficulty arise, will normally be provided. Otherwise, any concerns should be addressed to edlab@ja.net.

Data Protection: information about you and your visits to the EdLab Platform

JANET(UK) processes information about you in accordance with its privacy policy http://www.ja.net/documents/company/privacy-policy.pdf

By using the EdLab platform, you consent to such processing and you warrant that all data provided by you is accurate.

Details about you, including your User identification code, your attendance at an event, and, if you provide them, your contact details may be available to other Users on the EdLab Platform due to your use of the EdLab Platform. By using the EdLab Platform, you consent to your details being made available in this way. If you would like any of your details to be removed from the EdLab Platform or any part of it, please contact edlab@ja.net.

JANET(UK) content standards: uploading material to the EdLab Platform

Whenever you make use of a feature of the EdLab Platform that allows you to upload materials or information to the EdLab Platform (“Your Contribution(s)”), you must comply with the JANET(UK) content standards (“the Content Standards”) set out below. You agree that the Content Standards apply to all of Your Contributions and you agree to comply with the following Content Standards:

Your Contributions must:

  • be accurate (where they state facts);
  • be genuinely held (where they state opinions);
  • comply with all applicable laws in the United Kingdom and in any country from which your Contributions are posted;

Your Contributions must not:

  • contain any material which is defamatory of any person;
  • contain any material which is obscene, offensive, hateful or inflammatory;
  • contain or promote sexually explicit material;
  • promote violence;
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  • infringe any copyright, database right or trade mark or other intellectual property right of any other person;
  • be intended to or reasonably likely to deceive any person;
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • promote any illegal activity;
  • be threatening, abusive or have the effect of invading another person’s privacy;
  • be intended to cause annoyance, inconvenience or anxiety;
  • be likely to harass, seriously upset or embarrass any other person;
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  • give the impression that Your Contributions emanate from JANET(UK) or any third party, if this is not the case;
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Any Contributions you upload to the EdLab Platform will be for the purpose of sharing with other registered users of the EdLab service only on a non-confidential and non-proprietary basis.

You agree that JANET(UK) has the right to disclose your identity to any third party who claims that any of Your Contributions constitute a violation of their intellectual property rights, or of their right to privacy.

You agree that we are not responsible, or liable to any third party, for the content or accuracy of any of Your Contributions and you agree to indemnify JANET(UK) in respect of any loss or liability suffered by JANET(UK) resulting from Your Contributions.

We have the right to remove any of Your Contributions if, in our opinion, such material is deemed to be offensive or inflammatory or in breach of these Terms of Use.

Changes to the EdLab Platform

The content and functionality of the EdLab Platform may be changed by JANET(UK) and/or Fronter UK at any time.  If the need arises, we may suspend access to the EdLab Platform, or remove access indefinitely.

Our Liability

The materials and information displayed on and accessed via the EdLab Platform and its operation and functionality is provided without any guarantees, conditions or warranties as to its accuracy or operation.

To the extent permitted by law, JANET(UK) hereby expressly excludes: All conditions, warranties and other terms, which might otherwise be implied by statute, common law or the law of equity. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the EdLab platform or in connection with the use, inability to use, or results of the use of the EdLab platform, any websites linked to it and any materials and information posted on it or accessed via the EdLab platform, including, without limitation any liability for, loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and / or For any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

These Terms of Use do not affect JANET(UK)’s liability for death or personal injury arising from its negligence, nor any liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Ownership of information and Intellectual Property Rights

JANET(UK) is Fronter UK’s licensee of all intellectual property rights in the EdLab Platform. JANET(UK) and its licensees own all intellectual property rights in all material published on the EdLab Platform.

Other than your licence, you are granted no rights whatsoever in the EdLab Platform or any other intellectual property rights of JANET(UK) or Fronter UK.

You must not use any part of the materials on the EdLab Platform for commercial purposes. If you use any part of the EdLab Platform for commercial purposes, your right to use the EdLab Platform will cease immediately, Your Licence will terminate automatically and you agree to destroy any copies of the EdLab Platform or any materials published on the EdLab Platform, that you have made.

Consequences of breach of these terms of use

JANET(UK) will determine in its absolute discretion, whether there has been a breach of these Terms of Use through your use of the EdLab Platform.

When JANET(UK) determines that a breach of these Terms of Use has occurred, JANET(UK) may take such action as it deems appropriate including any or all of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use the EdLab Platform;
  • immediate, temporary or permanent removal of any of Your Contributions;
  • issue of a warning to you;
  • issue legal proceedings against you for reimbursement of all loss, damages and costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • take further legal action against you;
  • disclosure of such information to law enforcement authorities as JANET(UK) reasonably feel is necessary.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, use of the EdLab Platform. 

These Terms of Use are governed by English law and you submit to the exclusive jurisdiction of the English Courts.
